If I go into care my home will automatically go to my children right? - Wrong!
If in later life you were to go into long term care, the community care act 1990 allows the local authority to means test your house.
It is illegal to deliberately transfer your own property away to relatives or others if your prime motive is to avoid paying for long term care costs. However, it is not illegal for you and your partner to make provision that upon death your own 1/2 share of the property is placed in a trust for your children.
